Recruitment Privacy Notice

When you apply for or are referred for a role with Mercedes-Benz Grand Prix Limited (company number 00787446) (“MBGP”) your personal data will be processed by MBGP, who are the controller, under General Data Protection Regulation (EU) 2016/679 (the GDPR) and as it forms part of the law of England and Wales, Scotland and Northern Ireland by virtue of section 3 of the European Union (Withdrawal) Act 2018 and as amended by Schedule 1 to the Data Protection, Privacy and Electronic Communications (Amendments etc) (EU Exit) Regulations 2019 (SI 2019/419) (the UK GDPR). This privacy notice explains what MBGP will do with your personal data when provided or collected in connection with MBGP’s recruitment processes.

It is important that you read this Privacy Notice carefully, as well as any other recruitment information that MBGP may give to you. MBGP may update this Privacy Notice at any time by publishing the updated version on this page. When MBGP make changes to this Privacy Notice, the ‘last updated’ date at the bottom of this page will also change. Any changes to this Privacy Notice will apply to you and your personal data immediately.

The website, mercedesamgf1.com/careers displays career opportunities at MGBP. If you decide that you wish to click ‘Apply’ in one of these job adverts, you will be taken to that job advert on MGBP’s Workday system.

The website, workmyway.avature.net/MercedesTalentPool, allows you to register your interest for upcoming Industrial Placement opportunities.

What is personal data?

Personal data means any information about a living individual from which that person can be identified, whether directly or indirectly. It does not include data where the identity has been removed (anonymous data).

Some categories of personal data are deemed more sensitive than others, including but not limited to personal data revealing your political opinions, ethnic origins, sexual orientation, religious beliefs or data about your health. MBGP may only process these special categories of personal data in more limited circumstances.

How will MBGP collect your personal data?

As a candidate you will provide MBGP with most of the personal data about yourself that MBGP will hold and use, for example when making an online application through MBGP’s careers portal, registering your interest for Industrial Placement opportunities or by completing any assessments and during any interview(s). 

Some of the personal data MBGP hold and use about you will be from various internal sources used during the recruitment process. For example, you will be assessed by the person interviewing you, who will score your suitability for the relevant role and MBGP will record the reasons for decisions made about whether or not your application is successful.

Some of the personal data about you that MBGP hold and use may come from external sources such as a recruitment agency or from publicly available sources, such as your LinkedIn profile or other media sources. 

If you receive a conditional offer of employment, MBGP may also carry out pre-employment checks such as collecting references from previous employers and qualification checks via an external screening provider. MBGP will also request that you complete pre-employment health declarations which may require the assessment of an occupational health professional to report to MBGP on your fitness to do the relevant job. If MBGP are required by law, MBGP may also seek a criminal record check from the Disclosure and Barring Service. In some circumstances, MBGP may ask the Home Office for information about your immigration status to verify your right to work in the UK. 

What types of personal data will MBGP process?

As part of MBGP’s recruitment process, MBGP collect, hold and use the following types of ordinary personal data, including but not limited to:

  • information contained in the application form and your CV/covering letter, including name, title, contact details, employment history, experience, skills, qualifications/training (educational and vocational), copies of driving licenses and/or passports, referees’ names and contact details etc;

  • publicly available information about you, such as your social media presence e.g. Linkedin profile;

  • selection information, including correspondence, interview notes, internal notes, the results of any selection tests, assessment centres or trial days;

  • right to work checks and related supporting documentation, including immigration documents such as Biometric Residency Permits; and

  • diversity and equal opportunities monitoring information – this can include information about your race or ethnicity, religious beliefs, sexual orientation, disability and other ‘special category data’.

If you are shortlisted for a position, or you receive a conditional offer of employment, MBGP may collect, hold and use the following additional types of ordinary personal data about you:

  • pre-employment check information, including references and verification of your qualifications;

  • a pre-employment health declaration; and

  • criminal record checks from the Disclosure and Barring Service, where necessary.

For what purposes do MBGP process your personal data?

MBGP will use the information provided when you apply for a role for the purpose of:

  • assessing your suitability for the role and making informed recruitment decisions;

  • administering the selection process;

  • verifying information that you have provided;

  • communicating with you about your application;

  • complying with legal requirements (such as checking your right to work in the UK);

  • if you are successful in your application, offering you a contract of employment;

  • keeping records of MBGP’s recruitment processes and decisions;

  • furthering our diversity and inclusion initiatives; and

  • helping MBGP to develop and improve the recruitment process.

On what lawful basis does MBGP process your personal data?

Legal basis of processing

When you submit an application for a role at MGBP and/or otherwise engage in the recruitment process.

The processing is necessary to perform a contract or to take steps at your request, before entering into a potential contract (Article 6(1)(b) UK GDPR). If any of the personal data is special category data (such as health, religious or ethnicity information), MBGP also process this pursuant to the conditions relating to employment and the safeguarding of your fundamental rights in Schedule 1 Part 1(1) of the Data Protection Act 2018.

When MBGP carry out pre-employment checks which MBGP are required by law to do, such as checking that you are entitled to work in the UK and role specific criminal record checks.

To comply with legal obligations (Article 6(1)(c) UK GDPR).

If you provide MBGP with any information about reasonable adjustments you require under the Equality Act 2010.

To comply with legal obligations (Article 6(1)(c) UK GDPR) and to the extent such data constitutes special category data, pursuant to the conditions relating to employment and the safeguarding of your fundamental rights in Schedule 1 Part 1(1) of the Data Protection Act 2018.

If MBGP needs to carry out criminal record checks.

Where MBGP shares your data with companies within its group and with third party professional advisors, such as legal advisors.

Processing is necessary in MBGP’s legitimate business interests to obtain the necessary approvals of MBGP’s recruitment decisions and to deal with any claims or potential claims against MBGP.

Please note that MBGP may process your personal data for more than one lawful ground depending on the specific purpose for which your personal data is being used by MBGP. Who do MBGP share your data with?

Employees and group companies

Where appropriate, MBGP share your personal data within the company and with MBGP’s group companies to enable the necessary input and approval of recruitment decisions and to meet the internal compliance requirements of MBGP’s group. Those employees included in the recruitment process, such as (but not limited to) hiring managers and employees in the Human Resources department, will have access to the information provided in your application, including supporting documents such as your CV and covering letter, through MBGP’s Human Resources management system. You may be asked to undertake a technical activity to support the interview/application as well as other recruitment activities such as attending assessment centres, trial days, and the completion of occupational personality profile questionnaires. The data collected in these assessments and activities will be available to employees who are involved in the recruitment process.

Service providers

If you decide to engage in our recruitment process, you will be redirected from our website to a platform which is provided by a third party or will engage directly with a platform provided by a third party (including without limitation Manpower UK Limited), who are a data processor of MBGP. The third party provider will only process your personal data on our documented instructions, for example, if they need to access live data to fix any technical errors in the platform.

Recruitment agencies and screening providers

MBGP may share your personal data with recruitment agencies, outsourcing providers and testing providers (“Recruitment Provider(s)”), which are engaged by MBGP to source suitable candidates for MBGP’s vacancies. This allows MBGP to deal effectively with candidates during the recruitment process of shortlisting, interview and offer. MBGP will share any personal data with a Recruitment Provider that is necessary to enable both MBGP and the Recruitment Provider to fulfil their roles within the recruitment process. For successful candidates, MBGP use an external provider to conduct pre-employment screenings and background checks (references, qualification checks etc). MBGP will provide details of your email address, and relevant employment details such as start date to enable them to contact you to start the screening process.

Medical/occupational health professionals

MBGP may share information provided by a candidate for a request for adjustments to the recruitment process as a result of an underlying medical condition/disability with medical/occupational health professionals to enable MBGP to identify what, if any, adjustments are needed in the recruitment process and, if successful, subsequent employment. MBGP may also share details of disclosed medical conditions and/or answers to pre-employment health questionnaires with medical/occupational health professionals to seek a medical report about you to enable MBGP to assess your fitness for the job and whether any adjustments are needed once you become employed. This information may also be used by the medical/occupational health professionals to carry out assessments required by health and safety legislation.

Professional advisors

MBGP may share your personal data that is relevant, where appropriate, with legal/other professional advisors, to obtain advice about matters relating to a candidate e.g. immigration status or if necessary to deal with a legal dispute.

Home office

MBGP may share your right to work documentation with the Home Office, to enable MBGP to verify the right to work in the UK.

How long will MBGP retain your personal data for?

MBGP will keep personal data collected throughout the recruitment process for a period of 12 months from the date of your application.

If your application is successful, and you subsequently commence work with MBGP, you will be given access to the Employee Privacy Notice which will explain how MBGP continue to process information that MBGP hold about you in MBGP’s capacity as your employer whilst employed by MBGP and after they have ceased to be employed.

If you are not successful in your application, your personal data will be retained for a maximum of 18 months from the date of the last job application. For example, if you apply for a job application on 1 January 2020, and apply for another job on 1 January 2021, the 18 month period in respect of all personal data we hold about you will be calculated from 1 January 2021. There may, however, be circumstances in which it is appropriate for MBGP to keep particular items of your personal data for longer.

To the extent that you have used the candidate platform you may choose to delete your account on the candidate platform. If you do this, all personal data stored on the candidate platform will be deleted but we may still hold personal data about you outside of the candidate platform, depending on how far along the recruitment process you are (for example, interview notes).

MBGP will base these decisions on relevant circumstances, taking into account the following criteria:

  • the amount, nature, and sensitivity of the personal data;

  • the risk of harm from unauthorised use or disclosure;

  • the purposes for which MBGP process your personal data and how long MBGP need the particular data to achieve these purposes;

  • how long the personal data is likely to remain accurate and up to date;

  • for how long the personal data might be relevant to possible future legal claims; and

  • any applicable legal, accounting, reporting or regulatory requirements that specify how long certain records must be kept.

  • In all cases, MBGP will not keep your personal data for longer than MBGP need it for legitimate purposes.

How does MBGP keep your data secure?

MBGP safeguards the security of your data via means of physical, electronic and managerial procedures, and requests that you take your own reasonable steps to safeguard and protect your own personal data when you are applying for any vacancies with MBGP e.g. by changing passwords regularly and using a secure internet browser.

When you visit the careers page on MBGP’s website, you are able to do so anonymously. However, the web server may automatically record your IP address and the date and time spent on the MBGP website.

Links to Other Sites

MBGP will endeavour to only provide links to other sites that are from a trustworthy source. However, once you leave MBGP’s website, you should be aware and take note that MBGP has no control over any other website. MBGP cannot be responsible for the protection of privacy of any information that you provide on any other website. If you use any of the links provided to you from the website you should read their applicable privacy statement. These websites will not be governed by this Privacy Notice.

Social Plugins

MBGP uses social plug ins of social networks on its website such as Youtube, Facebook, Twitter, Google and Instagram (“Buttons”).

When you visit MBGP’s website, these buttons will be deactivated by default. To activate these Buttons you must click on them. Once they have been clicked they will remain active until they are deactivated by your or you delete your cookies. When the Button is activated, the social network can extract data independently, whether you interact with the Button or not. If you are logged on to a social network, the network can assign your visit to the website to your use social network account.

MBGP has no control on the data retrieved by any third-party site and you must consult their relevant social networking privacy policy or data protection policy, to find out how they use your data.

If you do not want to combine data extracted from your own personal networking site, and the MBGP website, please ensure that you log out of any social network sites before activating the Buttons.

Consequences of not providing personal data to MBGP

MBGP only ask you to provide personal data that MBGP need to enable MBGP to make a decision about whether or not to offer you a role.

If you choose not to provide MBGP with personal data requested, MBGP will tell you about the implications of any such decision at the most relevant time.

Your rights

You have the right to:

Make a Subject Access Request (SAR). This enables you to receive information about how MBGP use your data, as well as to receive a copy of the personal data MBGP hold about you.

Request that MBGP correct incomplete or inaccurate personal data that MBGP hold about you.

The right to request that MBGP delete or remove personal data that MBGP holds about you where there is no good reason for MBGP continuing to process it. You also have the right to ask MBGP to delete or remove your personal data where you have exercised your right to object to processing (see below).

The right to object to MBGP’s processing your personal data where MBGP are relying on our legitimate interest (or those of a third party), where MBGP cannot show a compelling reason to continue the processing.

The right to request that MBGP restrict MBGP’s processing of your personal data. This enables you to ask MBGP to suspend the processing of personal data about you, for example if you want MBGP to establish its accuracy or the reason for processing it.

The right to withdraw your consent to MBGP using your personal data. As described above, MBGP do not normally rely on your consent as the legal ground for using your personal data. However, if MBGP are relying on your consent as the legal ground for using any of your personal data and you withdraw your consent, you also have the right to request that MBGP deletes or removes that data, if MBGP do not have another good reason to continue using it.

The right to request that MBGP transfer your personal data to another party, in respect of data that you have provided where MBGP’s legal ground for using the data is that it is necessary for the performance of a contract or that you have consented to MBGP using it (this is known as the right to “data portability”).
