1. Prize Draw Eligibility and Entry Criteria
1.1 This Prize Draw is open to all persons who:
(i) are aged 18 years and over;
(ii) hold a valid passport;
(iii) are eligible to enter the United States of America; and
(iv) reside in Bulgaria, Czech Republic, Estonia, Finland, France, Germany, Latvia, Lithuania, Norway, Republic of Ireland, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland, United Kingdom, United States of America (excluding Florida and New York).
Each entrant warrants and represents that (a) they are eligible to enter in accordance with Section 1.1(i) to (iv) above, and (b) their entry shall not breach or render the Promoter in breach of any applicable law in the country in which the entrant normally resides and/or has entered from. For the avoidance of doubt, persons shall not be eligible to enter from any country not listed above as well as the states of Florida and New York.
1.2 The Promoter reserves the right to ask for proof of age and verify the identity of any entrant and/or the winners and/or their guest. Accordingly, entrants shall provide such reasonable documentary evidence as the Promoter shall specify in order to verify the age and identity of the relevant entrant, winner or guest and perform a security check. In entering the competition, each entrant confirms that they are eligible to claim any prize that they may win.
1.3 Employees, officers, contractors, consultants and other personnel of the Promoter (other than by virtue of being an entrant), and members of their immediate families or households, will not be eligible to enter the Prize Draw. Employees, officers, contractors, consultants and other personnel of any other Formula One Team will not be eligible to enter the Prize Draw.
1.4 Entrants must use their full and correct legal name and email address to enter the Prize Draw.
1.5 Entrants are limited to one entry per person. Multiple entries by one person using duplicate accounts will result in all entries by that person being invalid.
1.6 The Prize Draw shall begin on Wednesday 13th March 2024 at 09:00 (GMT) and end on Tuesday 2nd April 2024 at 23:59 (BST) (“Promotion Period”)
1.7 The Promoter has the right to disqualify any entry which it reasonably believes has not acted in accordance with the Prize Draw Terms and Conditions and/or for any other reason at the Promoter’s sole and unfettered discretion.
2. How to Enter the Prize Draw
2.1 To enter the Prize Draw, entrants shall be required to:
(i) click on the following link https://www.mercedesamgf1.com/promo/win-big-in-the-magic-city;
(ii) enter their full legal name and email address; and
(iii) submit their entry during the Promotion Period, (constituting an “Entry”).
Entries submitted outside the Promotion Period will not be valid.
3. Winner Selection
3.1 Following expiry of the Promotion Period, twenty seven (27) winners shall be selected at random (using a software randomiser) from all valid and eligible Entries and the winners will win a Prize in accordance with Section 4. For the avoidance of doubt, each Entry has an equal chance of winning a Prize.
3.2 Subject to subsequent verification of their details and a security check, the winners will be notified via email using the contact details submitted in their Entry on or before 16:00 BST 3rd April 2024. Entrants must ensure that they check their spam/bulk/junk folders and ensure the relevant account remains active in order to avoid missing the notification. The Promoter shall not be liable in the event that any notification is not received by a winning entrant in such circumstances.
3.3 Subject to Section 3.4, the winners will have seventy two (72) hours from the date upon which they are notified by the Promoter that they have won a Prize in the Prize Draw to claim their Prize (the “Deadline”).
3.4 If a winner does not or is not able, for any reason, to claim or accept a Prize by the Deadline, the Promoter reserves the right to award the Prize to another entrant and the previous winning entrant waives all claims against the Promoter in respect of the Prize Draw.
3.5 Each winner warrants that they will comply with any applicable laws in connection with claiming and receiving a Prize, including without limitation any taxation laws and regulations.
4. Prize
4.1 The prizes shall be won as follows:
(i) First Prize: the first two winners selected at random shall receive each:
· two (2) passes to the Mercedes AMG Petronas Formula One Team Miami Club at the 2024 FORMULA ONE™ CRYPTO.COM MIAMI GRAND PRIX;
· return economy flights from the winner’s nearest available international airport, which may not necessarily be the closest (“Departure Airport”) to Miami. The Departure Airport and flights are subject to cost and availability at time of booking. Both the winner and their guest must travel on the same flights. The Promoter shall consult with the winner on the required flights, however the Promoter shall have absolute discretion regarding the selection and booking of such flights;
· standard class hotel accommodation for the winner and their guest during the Grand Prix (one (1) twin or double room with double occupancy); and
· ground transfers to and from the airport, hotel and circuit while in Miami.
All other costs not expressly included are excluded;
The First Prize has an approximate value of £30,000.
(ii) Second Prize: the next five (5) winners selected at random shall receive a signed and framed pair of Lewis Hamilton 2022 racing gloves. Each Second Prize has an approximate value of £165;
(iii) Third Prize: the remaining winners selected at random shall receive an Official 2024 Mercedes AMG Petronas Formula One Team Black Polo. Each Third Prize has an approximate value of £50.
(each, the “Prize”).
4.2 For the avoidance of doubt, unless explicitly included within the definition of the Prize as described in Section 4.1, all other constituent elements which might, by implication, be included within that definition are expressly excluded.
4.3 Excluding the First Prize, all other Prizes shall be delivered at the Promoter’s cost to the winner’s address. The Promoter has discretion as to which method of delivery to use. The winner is responsible for ensuring that they are able to take delivery of the Prize on the arranged delivery date/time slot and the Promoter reserves the right to require the winner to pay for any additional delivery time slots if the initial slot is missed.
4.4 The Promoter reserves the right to amend, vary and/or substitute any Prize (or any part thereof) for a prize or prizes of equivalent or greater monetary value if this is necessary for reasons beyond its control.
4.5 There is no cash alternative to the Prize (or any part thereof) and unless agreed otherwise in writing, all Prizes are non-refundable and non-transferable.
4.6 Third party terms and conditions may apply to parts of the Prize where applicable, including terms and conditions of any airline(s), travel agencies and other transportation and the accommodation providers. Each winner undertakes to comply with all such terms and conditions and the Promoter will not be responsible for any failure to comply with such terms and conditions by such winner or their guest. In addition, each winner undertakes to comply with any applicable legal and regulatory requirements, including any health and safety guidelines and all reasonable instructions of the Promoter which are applicable to the relevant Prize.
4.7 The First Prize winner and their guest will be responsible for making all arrangements necessary to board their flight at the Departure Airport and to enter the United States of America, including without limitation any visa requirements, inoculation and health regulations. It is the sole responsibility of such winner and their guest to take out at their own cost all relevant insurance (including but not limited to health and travel insurance, insurance for theft, loss and damage to property etc.) which may be required or prudent to obtain. The Promoter does not accept any responsibility if any entrant is not able to take up their Prize.
4.8 The Promoter reserves the right at its sole discretion to suspend or cancel the participation of the First Prize winner and/or their guest due to non-compliance with any security procedures or any inappropriate behaviour or misconduct, which in the sole opinion of the Promoter, could cause harm or otherwise brings the Promoter’s reputation into disrepute. In such case, the Promoter will not be responsible for any costs associated with returning Winner and their guest back to their residence(s) or any other expense.
5. Liability
5.1 So far as is permitted by law and subject to Section 5.3, the Promoter and its associated companies and agents exclude responsibility and all liabilities arising from:
(i) any postponement or cancellation of the Prize Draw due to reasons beyond the Promoter’s reasonable control;
(ii) any changes to, supply of (including, without limitation, delays, cancellations and/or prizes which do not reach the intended recipient), or use of the Prize due to reasons beyond the Promoter’s reasonable control;
(iii) Entries that are submitted from jurisdictions in which this Prize Draw is rendered unlawful; and
(iv) any act or default of any third party (including travel agents, airlines or accommodation providers).
5.2 The Promoter does not accept responsibility for network, computer, hardware or software failures of any kind (including unavailability of email providers or any social network), which may restrict or delay the sending, receipt or processing of your Entry or for Entries which are lost, damaged, delayed or unreadable except as a result of the Promoter’s negligence. Entries must not be sent in through agents or third parties. Incomplete entries, and entries which do not satisfy the requirements of these Prize Draw Terms and Conditions, will be disqualified and will not be counted.
5.3 Nothing in these Prize Draw Terms and Conditions in any way limit the Promoter (or any other person or organisation’s) liability for:
(i) fraud; or
(ii) death or personal injury caused by negligence; or
(iii) any other liability which cannot be limited or excluded by law.
5.4 You agree to indemnify the Promoter in respect of third party claims arising out of or in connection with any breach by you of these Prize Draw Terms and Conditions, including for the avoidance of doubt, any failure to comply with any third party terms and conditions.
6. Personal Data and Publicity
6.1 The Promoter will use personal information about entrants for the purpose of administering the Prize Draw, including performing a security check, in accordance with the Promoter’s Privacy Policy which can be found at: shop.mercedesamgf1.com/pages/privacy-policy. By entering the Prize Draw, each entrant agrees that the Promoter may collect and use of his/her personal information in accordance with the Privacy Policy. Each entrant also warrants and represents that they have read the Promoter’s Privacy Policy.
6.2 Please note that your data may be processed outside of the European Economic Area, and by entering this Prize Draw you consent to this.
6.3 You agree that by submitting your entry, you grant the Promoter an irrevocable, worldwide, royalty-free licence (i.e. permission) for the Promoter and its agents and licensees to edit, publish, broadcast and otherwise use any videos, photographs and/or digital content arising from or out of the Prize for any and all purposes in any and all media throughout the world in perpetuity (or, where such a licence is not lawful or enforceable, for up to 50 years from the date the Entry is submitted to the Promotion), including, without limitation, on the Promoter’s publicly accessible website(s), social channels and all other media whether now known or hereafter invented.
6.4 You agree that you shall not publicise that you have won a prize and/or give any interviews without the Promoter’s prior written consent.
7. General
7.1 The Promoter’s decisions relating to the Prize Draw shall be final and binding in all respects. Entries that do not comply in full with these Prize Draw Terms and Conditions will be disqualified.
7.2 Entrants will be disqualified if in the reasonable opinion of the Promoter the entrant:
(i) has breached the Prize Draw Terms and Conditions;
(ii) has conducted themselves in an inappropriate manner contrary to the spirit and intention of the Prize Draw; and /or
(iii) has committed or undertaken any acts for fraud, misconduct, dishonesty and/or provided false information.
7.3 The Promoter may disqualify any individual who the Promoter believes that the entrant’s participation in the Prize Draw may cause harm to the Promoter’s reputation and/or bring the Promoter into disrepute and/or otherwise cause any negative press coverage (including on social media).
7.4 If the Promoter has grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsman-like conduct of any kind (including, without limitation, manipulating the Prize Draw, choice of prize winner(s) or any entry) the Promoter reserves the right (in its sole discretion) to disqualify any entrant, entry or person it reasonably believes to be responsible for, or associated with, such activity.
7.5 The Promoter may reject any entry to the Prize Draw (or may withhold the award of a Prize in respect of any entry) that is:
(i) automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);
(ii) completed by third parties or in bulk;
(iii) illegible, altered, reconstructed, forged or tampered with; or
(iv) incomplete.
7.6 Details of the prize winner’s name will be available for one month after the close of the Prize Draw by writing to the Promoter at the address set out below and stating the name and closing date of the Prize Draw. In the event you are the winner, you consent to such disclosure of your name in accordance with this Section 7.6.
7.7 You agree that, in the event that you are the winner of the Prize Draw, you shall execute (within a reasonable timeframe) any reasonable obligations and/or documentation as may be specified by the Promoter in relation to the Prize, including a confidentiality agreement.
7.8 The Promoter may add to, amend or vary these Prize Draw Terms and Conditions from time to time, at its discretion without prior notice. Any changes will be posted via these Prize Draw Terms and Conditions.
7.9 This Prize Draw and any dispute or claim arising out of or in connection with it (including all non-contractual disputes), shall be governed by and construed in accordance with English law. By entering this Prize Draw all entrants irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Prize Draw.
